In Nyawk you need a gummint permit to have a masquerade party in a hotel!

regular sex, unless you pay for it or one party is under 17, is not yet illegal in NY. Though if the Shakers ever make it back, watch out. Used to be a law on the books against deviate sexual intercourse. The law was struck down as unconstitutional, but I believe it has been repealed. Anyway, that line is a hold over from the old consentual sodomy statute.

The idea behind loitering is that you are hanging around without any lawful purpose. As I said, this story sounds like an abuse of authority, ther emay well be a city law that is more restrictive than the state law, especially since the summons was for loitering outside of a business, but no matter what, this sounds like either a revenue raiser, or some misguided "quality of life" enforcement blitz.

In Police Science, there is a whole style of policing called "Community Oriented Policing" amoung its tennents is what's called the "borken windows" theory. The idea is that if people see a building with broken windows, they decide that no one cares about the building, and it's OK to, for example, burn it down. If people see people getting away with minor crimes, the will decide that no one cares about the law in that community, and it's OK to commit serious crimes.

What ends up happening is that cops go around and drum up negativity amoungst the law abiding people by issuing tickets for jay walking and loitering, while the bodega down the street is getting held up. The other problem, at least in NYC, is that cops issuing these quality of life tickets were getting into fights (fist fights, knife fights, gun fights) with people who felt that public intoxication, or whatever, wasn't enough to warrant a ticket. I want to be clear that hitting or killing a cop, because he'd nitpicking is NEVER OK, (forget about them just followiing orders most of the time), but it doesn't take a much to see that comming in the enviornments they were doing this in NYC. Plus, they generally use kids right out of the acadamy for this work, because the brass thinks it's safe for them. It ends up, at the least, generating negativity.

So what part of the loitering statute that you posted were these guys supposedly violating? It doesn't seem like it fits at all.

I think the cop should be disciplined for making an illegal arrest.

No, read the statute. The cop was just abusing his power, here. Two friends talking on the sidewalk isn't even covered by the law. Neither is standing outside smoking, unless you are also engaged in other prohibited behavior.

Call it what you want.
They're issuing a ticket, not gassing jews.

No one was arrested, the ticket can be contested in court.
It will probably cost more for the lawyer, and lost time at work than it is worth, but it can be contested and won.

I don't know whether you're a New Yorker or not, but it seems to me, it truly isn't the cop's fault.
It's the voting public of New York that allowed idiots on the city council and in the Mayor's office.
If you don't like the way they're running the city, get rid of them.
