This should be a class action suit brought on behalf of all the parents whose children were forced to endure this monster. First and most seriously, the school failed in its duty to provide a safe environment for kids who could get poked in the eye by this disruptive child. Second and more legally seriously, the school allowed the problem child to call another a "faggot", which will turn every kid in class into a "walking time bomb" from the trauma.

We've gone through this whole gutless principal thing with our daughter who is in 3rd grade. Teacher's have been assaulted and he just can't throw the bad kids out.

My wife is a TA in a 'troubled youth' class. ( can't recall the PC name )

This is a middle school, 7-9th graders. They curse her ,etc. but have never gotten physical ,yet. I worry about her safety every day.

These kids raise so much he!! that they disrupt classes all around theirs.

I beg my kids to get my grandkids in private schools. One has.

My daughter teaches middle school in Florida. Many of her students are "from hell" She and the other teachers are threatened with lawsuits on a regular basis. " I can do what I want, and if you do anything to me , my mom will sue your butt off." When parents are called in, (if they even show up) they often accuse the teacher of lying, She tells of one incident where she sent a female student to the office because she showed up to school wearing thong panties and a skirt so short you could see them!(and everything else) When the furious mother showed up--guess what? She was dressed exactly like her daughter. This lawsuit threat is why many teachers join the union. They are not political, but think they need the insurance . My daughter is conservitave and non union. The union dues are $40 per week.!! And the non union teachers are under constant pressure to join.

I believe the teacher, however I have problems with her "pain and suffering" lawsuit. We all have difficulties we have to deal with. This unfortunate occurrance only lasted a finite period of time for this teacher. More fodder for the civil suit trial lawyers. Gimme a break

My mother was a fifth grade teacher and taught at a school for two years in which the average age of the student was 13 and she had two 16 year olds. The second year she literally could not turn her back on the class for her safety.

One of the students sister was in jail for stabbing a teacher the year before, there were no doors on the bathrooms, there was no play equipment on the play ground because of the "little darlings" propensity to make weapons out of them, when school was dismissed the cops had to supervise, etc...

Needless to say the stress didn't help her blood pressure, heart condition or mental state. She was on some heavy duty meds to make it through the second year that she was contractually obligated to fulfill. She was finally able to get off the stress meds after moving to the country and teaching in a school where there was discipline, God and no juvenile delinquents. It did affect her long term health, she died at 56 of a heart attack.

My grandson threw a "fit" in a DQ about a year ago when he was 2. He wouldn't do it at home but whenever I was out in public with him it was open season. Anyway, I'm trying to quietly make him behave. Two older couples were staring at us with obvious displeasure. Finally, I looked at them and said "yall gonna call CPS on me if I spank his butt?" Grins spread on all their faces and one said "we see nothing" and we all started laughing and the baby shut up. (He wasn't the center of attention any more).

Wonderful post. And this is a "right-to-work" state -- FL. Maybe Jeb Bush needs to address pressure by unions to join those organizations.

I was at a shopping mall several years ago. A 5-6 yr. old boy threw a tantrum right in front of me. He was literally laying on his back kicking his feet and shreiking. I'd never seen that before except on TV. The mother was squatted beside him saying " Now Johnny we shouldn't ..."...I offered her my belt. That did not go over well.

About fifteen years ago, An 5-year old kid was ripping toys out of packing @ Kroger in KY...the mother wasn't around, I followed that kid back to his mom, whispered to her what happen...she looked @ the kid, emptied his pockets, pull his pants, gave him a spanking -there on the spot in front of everybody...hopefully the kid mended his ways...if the parents are told...good parents (hopefully) will take remedial action quickly...

You are right. Private and parochial schools also turn a blind eye to disruptions so as to maintain the needed tuition from the families of these unruly youngsters. These young children sound like perfect subjects for a future "democrat" dictator who will let them do as they please so long as they fund the taxes.

My step-mother uses white or black pepper, administered for lying. It is quite effective.

I am inclined to believe the teacher

There is not a doubt in my mind that the teacher is telling the truth. I've been substitute teaching while between jobs, and the level of obnoxious student behavior, disrespect towards teachers, and threatening or violent behavior is staggering - And the schools have little latitude in dealing with the problem students.

The typical approach is to shift students from school to school. In the district I teach in, there is no ability grouping (except for the so-called "learning disabled" or special needs/MR kids) until high school - so every single class in K-8th grade is polluted with troublemakers who suck up the majority of teacher attention. When they become bothersome enough, they ship them off to be someone else's problem.

Isn't this primarily a problem of cowardly administrators and weak-kneed school boards, elected by a fraction of voters? Their fear of suits allows disruptions to continue. Then "they" wonder why the schools are "in trouble," as they mildly concede. Of course, administrators' answers are usually in two words: more money!

Exactly. Whatever you do..........do NOT make waves in the bureaucracy. It's the cardinal sin for which there is no redemption. Bureaucrats.........and worse, educrats.........deplore "wave-makers", and they love to just cruise along nicely in their cushy jobs where nothing is asked of them.

I have absolutely ZERO respect for educrats.

Among the child's offenses, the suit details how he purportedly stabbed a classmate with a fork at lunch, started another fight and then told a teacher's aide to "kiss my butt."

I don't see how this gets the teacher all that medical leave (maybe the stabbed classmate). Lucky for her she was only dealing with little 5 year olds and not dealing with middle school kids who would come up with worse than "kiss my butt". To me it sounds like she might not be cut out for teaching.

The woman is 51 and a "veteran teacher," the article says. Do you think she was originally "cut out for teaching" but is no longer?

Many liberal administrators do consider "controlling" pupils the No. 1 qualification for a teacher. Some say that pupils will NOT misbehave if they are being "challenged" and presented "interesting" lessons that hold their attention.

As a high school teacher I have often thought about taping my classes so I have proof that students are being disruptive. Then I realized it would be pointless since our administration does not punish students even when they admit to bad behavior.

In fact, liberal administrators say that POOR teaching methodology is the cause of unruly student behavior. They say that if the teachers will "get the student involved in the learning process" that all will learn and succeed. I have sometimes wondered if liberal administrators really believe their own rhetoric, or if they are just opportunistic and greedy for tax and tuition funds? Also, have you ever wondered why nearly all administrators are liberals?
