Don't bash filibustering too hard - it's really helped us in the past. Frist is WASTING everyone's time with these parliamentary games. BUSH must stop hiding behind him and immediately RECESS-APPOINT MIGUEL ESTRADA OVER MEMORIAL DAY WEEKEND, along with dozens of other nominees on whom the Senate has failed to act.

I don't blame Estrada one bit. Two years in the mustard-gas-filled trenches is enough for anyone. Watch GW make lemonade out of this lemon of a situation. Bush could have put Estrada in place already with a recess appointment. He would be sitting on the bench today and the RATS could do nothing to stop it. A real shame. THAT is the nuclear option...not these Senate games.

I wonder if the White House has just gotten definite word of imminent resignations from the Supreme Court, and has decided to nominate Estrada for that court instead.

But we do need to change the rules of the Senate - neither party should be able to hold nominations up indefinitely.
I tend to agree with you on this, Nina. This judicial nomination war has been going on for at least 15 years and it is obviously getting worse.

I think we are on track on this. I was concerned at first but it is beginning to look like wishful thinking from the left.
The President did a job on the Craps today, made them look like the idots they are and said he was going to get his man and Owen. Frist stepped up to the plate this morning and is starting to fight. He got some great bull pulpit backing on it this afternoon.

How has filibustering helped us in the past?
We defeated Abe Fortas from being appointed to the Supreme court in 1968 because of his civil liberties stance, in the very first filibuster on a Supreme Court nominee, which allowed Nixon to pick a conservative for the court instead of Johnson's choice of Fortas. In 1988, we filibustered against the Campaign Finance Reform bill (Robert Byrd invoked a little known rule which required people to be on the floor at 12:30 AM, and there was a scandal involving the Sergeant-In-Arms trying to drag people back to the floor). There's a number of cases; it's a useful tool to fight against policies that are unjust when you're not in the majority, but it's hard to pull off, and sacrifices votes because you're (rightfully) viewed as obstructionist when you do it.
So, don't demonize the filibuster too much. Just go after the Dems for using it in a case where it's not justified.
