No, that's in fact BSA policy almost straight off of the BSA's web site. The BSA will not inquire into your sexual orientation.
The BSA does not discriminate against homosexuals for what they are. The BSA discriminates against that subset of homosexuals that exhibits behavior that makes their orientation publicly obvious - to wit, those homosexuals who "avow" their homosexuality. The BSA knows, and has publicly acknowledged, that they have homosexual youth and adult members. As long as they don't make a public point of their orientation, they're welcome to join and stay.
Is this ALSO perjury: Appellants did agree to a modified version of a "don't ask, don't tell" program, in which appellants stated that they considered such matters as sexual orientation to be a private matter, which they would not ask anyone to divulge, and appellants agreed to obey any laws actually forbidding them from engaging in any illegal discrimination.
