No, of course not. I've argued the 10th amendment forever (not just on drugs). However, even if the Feds backed off, there are still 50 state laws we have to deal with in which case we'd have to use comparisons and decide cost effectiveness.

A government exists by the consent of the governed. Likewise, it exercises its powers with the consent of the governed. If the government exercises powers that the Constitution forbids it from exercising, and we do not object, doesn't this pass for consent? In which case, wouldn't this render the Constitution irrelevant, because the government is violating the Constitution, with the consent of the governed?

You are correct, and unfortunately the 'growing, living breathing constitution judges' think its ok along with our socialists representatives.

But that misses the simple point. Get rid of the feds and you still have 50 state laws to deal with, therefore, both types of arguements need to be administered (lawful reasons as well as logical reasons).
