They’re not US citiso they can’t commit treason, they’re committing espionage which can carry a death penalty, However since the bruha over executing the Rosenbergs we’ve been reluctant to pull that trigger.

There are good reasons not to execute spies:

1. If they’re dead they can’t tell you about their target, mission or support network,
2. You have nothing to trade with to retrieve our captured spies.
