So basically the US Marshall employed Texas rules instead of DC rules. If this is allowed to stand, everyone arrested over shooting to protect property can cite this case and raise selective prosecution concerns.

So basically the truth is a person parked outside a condo building in DC sitting in their car was carjacked returned fire and killed the carkacker. This has nothing to do with Sotomayor or the fact that this guy was on her security detail. It has nothing to do with a building of 45 condos which could belong to anyone. Where’s the threat to Sotomayor ?
