The weak spot in Hur’s defense of not charging him is that he’s using Biden’s current memory issues as an excuse to not determine that his illegal acts of years ago were wilful.

Hur brings up Biden’s memory to explain why he didn’t feel he could prove Biden’s criminal intent beyond a reasonable doubt, to a jury. In other words, Biden’s memory is so bad that it could reasonably be argued that he didn’t realize what he was doing, and therefore intent couldn’t be proven. The problem with Hur’s argument is this. The issue of intent doesn’t relate to Biden’s current mental state, but his mental state 8 years ago, when the events in question took place.
