Proving something is unreliable and therefore, in this case, unconstitutional allows for a quicker solution to the problem than proving criminal action, culpability and prosecution.
Some prefer to focus on solutions rather than problems. Solutions are more productive than blame and punishment of the wrong doers.
I think Mike was proven right and is vindicated in so much as the judge could rule.
