Amy thoughts on this? Gorsuch has indicated in the past his concerns about administrative state overreach.
The tea leaves aren’t real clear.
There are 4 cases left:
1. WV v. EPA from February
2. Torres from March
3. Biden v. Texas from April
4. Castro-Huerta from April
Thomas, Sotomayor and Gorsuch each have written 7 opinions. I think they may each be done for the term.
Roberts, Alito, Kagan and Barrett each have written 6, most of them will be done for the term.
Breyer has written 5. He is probably writing another.
Kavanaugh has only written 4. Kavanaugh probably has two of the four remaining opinions.
For February, Alito, Sotomayor, Kagan and Roberts have not written. There were only 7 cases for the February sitting, so some Justices were going to get left out. It is not unheard of for Justices to have two opinions. I think either Roberts or Kavanaugh has EPA.
For the April cases, I think it depends on who gets EPA. If Kavanaugh has EPA, I think Roberts will write Biden v. Texas. If Roberts has EPA, I think Kavanaugh will write Biden v. Texas
My gut is that Breyer has Castro-Huerta and Kavanaugh has Torres.
Now is the time to replace local, state and national GOP officials. Do you realize Mitt Romney’s niece still has a say in the GOP? We take over the GOP at the precinct level and work our way up. It is a battle. It is war. These establishment types are the enemy. They need to be defeated. It’s not fun, but eventually it will be rewarding.
