You would have been correct 5 years ago, but in today’s military the Flag/General for that base may demand that he be recalled to active duty and charged with conduct unbecoming of an officer. Then a Courts Martial and loss of retirement pay, health benefits, base privileges, reduction in rank and dishonorable discharge.
This is the WOKE military so don’t put anything past them.
