I don’t disagree, but that was never the Founder’s intent. If you read through the document, you will not find that power granted to SCOTUS. Again, the Founders, perhaps in their post-revolution naiveté assumed that Congress would never pass a law that violated the Constitution.

SCOTUS simply assumed the role in 1803 with Marbury v. Madison and it has become a very important ‘unwritten’ part of our Constitution. Interestingly, the Constitution does give Congress the power to limit the reach of the Judiciary, but it has never (to my knowledge) done so.

It is vital that none of the Republican appointed Justices die or retire for at least 2 years. By that time I think its likely Republicans can retake the Senate and block any Biden/Harris nomination.
