There is a precedent in history. In England Oliver Cromwell a hated leader, was dug up from his grave of several years and his head displayed publicly.
The impeachment by the House was stupid, but allowed. President Trump was President when he was impeached for a second time. But the trial in the Senate is the Senate trying a private citizen and that could or should be challenged as a Bill of Attainder.
The "simple" defense is to argue that impeachment is specifically a mechanism for Congress to remove federal officeholders, and has no applicability to a former officeholder. If such a person committed crimes, they are to be indicted and tried according to the normal criminal procedure before the usual criminal courts.
It’s James Madison’s fault for not foreseeing a situation where a President would be impeached a few days before the end of his term, not allowing time for a trial to take place.
We can always dig him up and impeach him. Nothing says we cant.

So something that is being stated is let them convict Trump if they have the votes then just have Trump run again. The DIMS will have to bring a suit against Trump to SCOTUS to prevent him from running and then SCOTUS would rule Trump can run. It would be hilarious if it weren’t so damaging to our Republic.
I would sue the Senate on sixty amendment grounds for a speedy trial and have them have the trial NOW and not wait for Biden’s honeymoon to be over nor for the Senate to dig up former porn stars or some sort.

It’s really pretty simple. President Trump KICKED THEIR COLLECTIVE BUTTS, Busted the Plan, smacked them in the face and worst of All (GASP!!!) KEPT HIS PROMISES TO AMERICA AND THE AMERICAN PEOPLE !!!!!!
President Trump truely Loves America. President Trump SCARES the “establishment” and President Trump did more in 4 years than any other President and that was even while Both SIDES OF (see My Tagline) mostly refused to work with President Trump.
