thx
Not sure. It may be possible to do a sampling of precincts if the Court so orders.
“In a tweet announcing the lawsuit, the Arizona Republican Party also argues that a sampling of precincts would potentially produce a more accurate sampling of votes compared to a sampling of voting centers.
“The question here is one of statutory construction, and whether the Secretary of State’s Election Procedures Manual is able to supersede Arizona’s state law,” Arizona Republican Party Chairwoman Kelli Ward said in a statement.
A court in Pennsylvania accepted a similar argument from the Trump campaign, ruling on Thursday that Pennsylvania Secretary of State Kathy Boockvar lacked the “statutory authority” to change election law just days before Election Day.”
That is actually a really interesting question. One might also wonder if you get a different result if the date on the machine were changed to a month before the election. Another run with the date set to a month after would probably be worthwhile. The software could be set up to generate perfect results in testing, and different ones on/after election day. That's how I'd do it if I were to do something like this.
And I believe Justice Alito said the same about another action that the Pennsylvania Secretary of State tried. That should give a pretty good idea on what the chance of the Arizona suit has of succeeding.
