The early history of civil forfeiture is dicussed in this article.
well all we can say here is that we sure hope it passes and soon
we are making our police and justice system so very CORRUPT knowing that they can steal our property almost at will....
with zero consequences and usually they wind up keeping it too
as bad or worse than many police states/dictatorships, we’ve seen both ways (stealing under this asset forfeiture system and stealing directly without regard to same). getting rid of the first kind of police theft will be a big big improvement for us all! in most places, we pay very generous wages for our police — they do not need to steal our property from us!
The left have a miserable record on criminal justice reform i.e Biden and the ‘94 crime bill ..
If you mean left by ACLU I guess you’re right but they seem to ignore so many abuses when “their guy” is in office...
Interesting - thanks! The early rationale applies in few if any modern cases: “Most important to understanding these early cases is the underlying rationale for permitting civil forfeiture even against innocent property owners. The Court reasoned that civil forfeiture was closely tied to the practical necessities of enforcing admiralty, piracy and customs laws. Such forfeiture permitted courts to obtain jurisdiction over property when it was virtually impossible to obtain jurisdiction over the persons guilty of violating maritime law.”
