I doubt that it's a stupid question but not being a lawyer myself I don't know the answer.My sense is that any court cases that arise from what the President has called a treasonous conspiracy (which sounds pretty accurate to me) will occur in Federal courts.

I've heard it said by Joe DiGenova that General Flynn has a great case against various individuals and bodies (DOJ,etc) for civil damages.And then there's the possibility of criminal cases.

Just saw Senator Kennedy on fox biz, the evening edition w/ Liz.
When asked if Obama knew about all of this (meaning was he involved) he said several times he hopes not, would need to see proof.

Which, IMO, is out there in black and white that not only did Obama know about all of it, but was running it.
