Youre right. He would never be convicted of any crime. But that wouldnt stop the cops from arresting him anyway. They could charge him with evicting a tenant without giving notice, breach of the peace, or some other such nonsense.

If nothing else, it violates the Fifth Amendment’s prohibition on the uncompensated taking of private property for a public purpose. The homeowners should file a claim for compensation and then a suit in federal court.
