I guess this is why I’m not a big Levin fan: he always correctly assesses what the enemy is doing, but he never gets around to innovative legal RESPONSES.

Supreme Court will say this is a political question and a separation of powers issue and they have absolutely no constitutional authority to get involved.

Constitutionally correct. But Roberts might say it is a tax!

Are you sure? The issue of separation of powers and the constitutionality of "impeachment" for arbitrary and unconstitutional purposes might be one that the Supreme Court should address.

Certainly Justices Kavanaugh, Thomas, and Gorsuch have witnessed the weaponization of legal distortions for political purposes and might be willing to address this issue.

time to stick it to the Dems

This depends on a huge presumption: that the new Republican House Speaker is inclined to do such things.

If the house were flipped, who would likely be Speaker? Some senior NeverTrumper whose "turn" it is for the gavel, or someone who will implement our wishes and PDJT's agenda?

Best thing the Senate can do is have hearings on the Ukraine corruption. Publicize how Biden, Pelosi, Kerry, Schiff and others used the Ukraine as a prosecutor free corruption zone and laundered the money through their dumb children such as Hunter Biden and Paul Pelosi. It will demonstrate just how corrupt these lowlifes are, the basis of Trump’s desire to root out the corruption, and why at its core the impeachment fiasco was an attempt to hide this corruption. When this is over, it is more likely that Pelosi will lose her office in shame than Trump losing his. Sure there are some Republicans such as Romney who had their hand in the corruption and will try to prevent a real investigation.

Nancy is bluffing. Her rationale about needing to know the arena before selecting managers is nonsensical.

I’ve had enough of all of this. The Democrats are beyond evil.

I have been trying to research what holding this really means in the long term. Does anyone know if there is a expiration date on sending it to the Senate?

It's possible that the House is holding until after the 2020 election in hopes of picking up a few Senate seats in the election that would change the landscape. Doesn't appear to be going in that direction but we are a fickle electorate.

Another possibility is the House hopes to use the Articles as a hammer to pressure the President toward their will.

In either or both cases, it seems the House should be compelled to "put up or shut up" otherwise upsetting the co-equal balance as designed. The president should sue for performance making the argument.

As someone just posted.......Democraps have succeeded in making impeachment trivial

Just as Obama made the Nobel Prize irrelevant.

Exactly right. McConnell will rightly say that he's not going to waste the Senate's time discussing rules if the House isn't going to send over the Articles of impeachment. Pelosi will look like an idiot going through the entire impeachment process, then doing nothing with it.

Dumb move on Pelosi's part.

The Constitution basically says upon passing the vote, the Senate handles from that point on. The head of the Senate would then control timing and events.

I think what Mitch will do is call for an immedate meeting to start the impeachment, with the Democrats saying he has to agree with things or there’s no articles passed over. He’ll say the articles don’t matter, and the Democrat Senators will leave the chamber.

At that point, he can call for an acquittal vote, with a 2/3’s vote....of the 56-odd people there, and merely needs 37 to conclude his impeachment episode. All done in less than 30 minutes.

Now, I admit....it will trigger massive hostility, but since you already have it....well, it won’t matter.

Impeachment would die with this Congress. They’d have to vote again after the new Congress is sitting.

It takes 4 to take a case, we only have 3 conservatives, Alito, Gorsuch and Thomas.

Clinton was impeached Dec 19, the Senate was informed January 9.

Senate doesn't have any justification to dismiss, with prejudice, what it doesn't hold.

This is just Pelosi and lawfar eating up the news cycle with more nonsense. Also attmpting to taint the Senate trial, becuase they know the trial will also conclude in partisan fashion.

Bring on the witnesses.

*****************

THAT is precisely what she and her fellow conspirators are afraid of. Testimony, evidence and facts will expose and destroy their fabricated and baseless case against the president.

Sunlight is the best disinfectant. We need an open trial.
