Oh. Well in hindsight that was an obvious and fatal (to the case) mistake.

Separately, this story hasn't made a single dent in the news. Contrast with unsubstantiated allegations of anybody claiming to be a Trump grope or rape victim.

In my experience, a very significant numbers of attorneys act in support of ONLY THEMSELVES. This is particularly true in political circumstances. It's great if it also helps their clients, but if it hurts their own situation, client be damned. I know nothing of Flynn's first attorneys, but I certainly wouldn't be surprised if they acted in their own perceived interest first. It often even seems that the higher they are paid, the more they act only in their own interest first.

Effectively representing Flynn to the benefit also of Trump would be a career ender for any beltway attorney. It the same at DOJ. Literally nobody there wants to prosecute McCabe. So they’ve been playing political football with his referral for over 15 months.

One of the things that needs to be changed at the FBI is the whole process surrounding ‘302s’. The interviews should be recorded and preserved. This entire process of writing up the agents recollections of the interview and calling it an official record should be completely abandoned, as it is just asking for fraud to be committed by the government. The only reason not to record the sessions is to facilitate government wrongdoing.

What’s wrong with the FBI? Don’t they understand that you destroy all evidence that you don’t want released as exculpatory or that shows you’re dishonest? The FBI is a poor second to the Stasi.

Trouble is, this pleading asserts that either the government has the documents or it deliberately destroyed them. And either way, the government is at fault for not producing them.

The original judge on the case was a friend of Peter Scztruk (sp). He was replaced by Judge Sullivan, who is a stickler for Brady warning the prosecution - and has been ever since he presided in the court when Senator Stevens was railroaded. When Judge Sullivan found out he had been deceived - and that, absent a Brady warning in advance, that he had no recourse against the deceivers - he started crusading for all judges to issue preemptive Brady warnings.

The Stasi didn’t have to worry about judges like Mr. Sullivan.
