If they are citizens, the fear is irrational. If they are non-citizens who are legally in the country, the fear is irrational, too. If they are non-citizens who are not legally in the country, the question is justified, and the fear is rational but not legitimate.
A shoplifter has a rational fear of the beepers that go off when they leave the store, too. Would Justice Sotamayer require department stores to remove them, using the same logic?
