As far as I understand it is illegal only in California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington.

From what I’ve read that IS where she taped Kelly when he fired her. This was a phone call from the president to her or vice versa so it’s not likely they were in the Situation Room...

Not necessarily. There is also a case of hacked phone and then no parties of the conversation are consenting to being recorded and the one doing the taping is the hacker.
