Imitations are permitted under TRIPS 31 under certain conditions and national law. Unlike the USA, most foreign countries aren’t run by ideologically blind idiots, they insisted on protecting drug access for their people.

US law doesn’t allow for domestic TRIPS 31 imitations.

The problem is that the FDA and federal law overreachs.

An early 1960’s safety problem of a drug was utilized to give the FDA power to insist on drug efficacy.

Your doctor would never prescribe a drug for you unless he/she thought it would work for you.

It would save everybody lots of money if the FDA just did safety checks well and drugs were sold on a money-back guarantee of efficacy and usefulness.

OK, let’s start a discussion on this. Let’s assume that there were no FDA... how do we ensure that a drug that was developed meet all the health and safety standards needed and also does what it is supposed to do?

The people of each state through their representatives, state-by-state. And without a constitutional amendment, the ONLY government that can validly get involved are state governments.

Many, as I, believe the voluntary cooperation between buyers and sellers in the open competition of supply and demand marketplace free from government interference is the best vetting process. Individuals are much more concerned about their own health than some stupid bureaucrat somewhere in some state capital or even worse in D.C.

And courts are available as a backstop for fraud and negligence.

The Commerce Clause (CC) was intended to remove barriers and hindrances to interstate commerce.

The CC is NOT a delegation of sweeping authority to feds to regulate our food, drugs, or anything that moves.

From what I can gather here (quickly) online, that would cost in Switzerland about 500$.

Interesting is - the company is NOT a US company - they are Italien - which means the whole R&D argument is moot - only the approval from the FDA can me considered as a cost extra for the US.

The pharmaceutical companies are always crying crocodile tears about R&D costs but somehow always find hundreds of millions for advertising and even more for pharmaceutical reps to push drugs.

Sweeping regulation on our food and drugs is not selectively eliminating barriers and hindrances to interstate commerce.

The FDA is prima facie or on the face of it, unconstitutional.

Thanks SeekAndFind. Forbes' concern is the massive R&D spending the US drug companies undertake, which subsidizes the cost of drugs in other countries. Meanwhile, FLAKE wants Obamacare for Dreamers.
