No that is not the issue. It is a matter of tax avoidance, at least partially anyway. The foundation has an undue influence upon the for-profit company which is making a partially deductible contribution to the private foundation, hence they must divest themselves of the for-profit corporation.

You need to read the US constitution.

The foundation is a protected contract under the constitution.

Any tax law that impedes that contract is unconstitutional.

They were known to be regular Joes...lived modestly and were respected by the townspeople.

Newman's charity does great work for seriously ill children. Lots of them.

That's great. More power to them. But in 2016 they also spent nearly $700,000 on lobbying efforts. Care to speculate which party was the beneficiary of most of those efforts?

Non-profit does not mean they cannot end up with more money. Non profits do not have a goal to make more, but if they do if they still appear to be doing their purpose its incidental that they end up with more money.

I seem to remember that the Houston Chronicle which had been 100 percent owned by the Houston Endowment Inc. (foundation)since the 1930’s was sold to the Hearst Corp. sometime around 1986 or 1987. This sale was due to the tax reform act of 1969. That is probably the same law that forced this sale.
