Carbonation is not the basis of the tax, it is sugar. The example picture from Costco is of Gatorade. Soda and/or Pop refers to the carbonation of the drink. (the tiny bubbles)

The crime is they are committing child abuse by taking their increasingly obese children down the road to a lifetime of ill health and disease that the world has never seen before.

A crime? Are going to throw the parents in prison along with the sugar producers and distributors as you suggested earlier?
