Is a “terrorist attack” a federal crime or military crime that could result in the death penalty, if convicted?
He should be facing the death penalty and conviction should be a slam-dunk for a halfway competent prosecutor. (We don't know how many useless slugs are left over in DOJ from the Obama years, true. But it won't be Holder or Lynch assigning the case.)
He was arrested at the scene with a "smoking truck" screaming "Allahu Akbar". It's going to be difficult to formulate a defense. (Although his lawyers will try.)
I'm confident that he will be executed. Less confident that it will occur during my lifetime.
Fellow prisoners will take him out. Let him go to jail and wait for it to happen.
Put him on the street and use him as a speed bump.
He will give interviews and speeches via video and he will be a hero in most colleges. The snowflakes will cheer when he says he hates America and he describes how he drove over bodies. Antifa rioters will have book burnings in his honor.
NYS won’t execute convicted cop killers.
