And the answer is no. The Enhanced Whistleblower Protection Act invalidates such NDAs. Now to be clear, the Act does not authorize passing classified or restricted information to those not cleared to receive it. But an appropriate congressional committee can receive such information.

The question was more rhetorical, but you bring up an interesting point WRT classification and the law. Suppose we have a program which is blatantly contrary to the Constitution, but falls under classification and NDAs — would disclosure of such a program to the general public be illegal?
- If Yes, then you are asserting that normal legislative actions are of higher precedence than the Constitution which both places limitations on the government and gives Congress all its power to enact law. [IOW, it is asserting that the commissioned is indeed of greater authority than that which commissions.]
- If No, then what implications does that have for (a) the legal system, (b) the classification system, and (c) redress of such grievances.
