It is not hard for a cop to get a legal warrant if he has probable cause, especially in a good sized city.
Warrants are required.

SCOTUS said while warrantless preliminary alcohol tests are legal, warrantless blood tests aren’t. The Court also noted that many states have criminalized PBT refusals.
In the case you referred to, the operator also refused a PBT, which could have landed him a misdemeanor in that state and not just license suspension.
In the Army a hero is certainly not someone standing up to a traitor within the ranks ... and the causies of a soldier suicide are always a personal family thing...
I always thought BLM was actually a group helping cops, siphoning attention from real problems caused by cops to a false flag issue on race. Even if racism was pervasive amongst police, the main issue is that no one can lie to a police officer but some police officers constantly lie to people to create a guilt posture.
That being said, so long police will seem to take out more trash off our streets , a thankless heroic job I do not envy, some innocent people might have to go to jail now and then. No system is perfect.

Sadly, the only way to punish bad cops is to make it so painful for municipality's finances that they start to take it out on the cops funding.
I my town, the police department lasted about 60 year from incorporation.
Then the City Council, with wide support from the residents (read: taxpayers), closed and defunded the Police department entirely, liquidating their assets.
We kept the Fire Department, though.

I was wondering the same thing. He evidently received phlebotomist training so he could draw blood. The linked article states he has been suspended from the blood draw program.

Sussex police Dept in Sussex NJ got liquidated due to the PD selling and using tbe evidence in the evidence locker.
Bunch of criminal cases that should have been slam dunks were overturned because the evidence introduced in court was fake “stand in” replacements for the real stuff that was resold or used.

I think it is a sociological fact that to be part of police you must fit a certain profile or attitude. It is a good idea to be on one’s guard any time meeting a woman or police or even black people. Sayig something which could be perceived the wrong way to either could yield some trouble,
The racism and jingoism of blacks is all too well known. I once tried to defend black coworkers from women falsely accusing of sexual harassment, but because I targeted both a white and black woman , and that they did not want the black woman to be targeted, they started recanting and making me look bad.
Women cannot be defended either, as telling them or “mansplaining” them of danger forces them to get out of their feelings zone, and since they always have feelings for and against danger, they will react with hostility towards you, saying you violate their freedom to do whatever they want.
As for cops, they shield themselves with a status of opinion making and testimony shakedown artistry. Try “mansplaining” something to a cop on an accident scene, and they will take it personaly as if you are acting as a cop on them. Also mention potential gang members, communists and scumbags infiltrating their ranks, and at best they will look at you like you are crazy, even though your intent was to defend the ranks and honor. In the Army, if a soldier screwed up and dishonored the ranks, no one liked him, it was shameful. In cop circles they always defend the perp. Just a casual look on Army forum and the reaction about a potentially bad soldier is quite different than the reaction about a potentially bad cop in a cop forum.

Thanks for that Heavy.com link, a read through that reveals that Payne is a real piece of work.
I will start by saying I do not know all the circumstances are facts involved in us and I’m guessing almost nobody else does either and are just basing it upon a video.
There are exceptions to needing a search warrant to seize evidence one of those is consent of the person in possession of the evidence, the owner shall we say can agree to hand it over, that does not apply in this case.
Another exception is if the evidence would be destroyed or spoiled if it is not ceased immediately.
I don’t know if that’s what the detective was going on that he thought the blood evidence would be destroyed or lost for ever if he did not seize it from the nurse right then
I will withhold judgment on all of this until I know all of the facts and not just the commenters on a YouTube video one thing I did note is it looked like the department did not suspend him from work but just from picking up blood evidence at the hospital. I think if they thought I did something wrong they probably would have suspended him and send him home on administrative leave.
