Why is a H1-B visa even allowed in this case? Students should come in on a F or J, period.

They come on the F visa for students (or much less commonly, J for professors), but once they finish their degree program, most want to stay for a year to gain job experience in the US as well. It makes them MUCH more marketable back home. US degree, US experience, US business contacts, much better English communication skills, etc. I helped numerous Chinese F students with their graduate programs at a Big Ten university, and I support the H1-B program. Most aren't looking for permanent status, they are just trying to maximize their position for when they go back home. (Ideally, they hope for positions that will allow them to return here often, to do business, but they prefer to live in their home country.) They make significant contributions on our campuses, they help us to do more business abroad, and they aren't like the tens of millions of illegals who are taking and leeching and thumbing their noses at us. These are the hard-working and intelligent folks who help us make the world a better, more civilized and Westernized place.

Those "institutions" that are acting as visa mills to help the non-exceptional students to find a way to hide and stay should be shut down though.
