The 12th Amendment only allows the House of Representatives to choose from “the persons having the highest numbers not exceeding three on the list of those voted for as President.”
That is the basis for the McMullin campaign in Utah. If he could win one state, he would be the third potential candidate if the House of Representatives where to choose the President.

The house can only consider the three candidates with the greatest number of electoral college votes for president. The vice president is elected by the Senate from the two candidates for vice president with the greatest number of electoral college votes.
How many states that Hillary is likely to win in a tie scenario have GOP majority delegations? And vice versa?
Which means if it’s a tie and the GOP loses the Senate, Kaine will be Trump’s V.P.
