The Democrats can put anyone on earth on the ballot at any point before the regular polls open for voting. Legality is not relevant.

There is plenty of precedent for leaving the votes as they are.

The question would be moot almost everywhere because the early votes would have to exceed the winning margin. Hillary plus Biden votes would exceed the Trump votes, but the Biden votes by themselves would not. And that situation would have to determine an Electoral College outcome. Very unlikely scenario.

Florida in 2000 indicates that votes can’t be reassigned after the fact, and Congress could simply accept the disputed EVs as they saw fit.

But you are right, in that the courts are a leftist wild card, but could only act in case of a Florida (or some other state) 2000 repeat. Will this election really be that indecisive?
