If top secret emails from a closed and secured Defense Dept system were found on her home server, than those had to have been somehow manually removed from their authorized location, no ? Although I doubt they were preserved word for word to the original like Petraeus having copies of confidential material in his desk drawer which could be a potential sticking point.

I worked in the aerospace industry for 25 years as a technical editor and proposal coordinator, holding security clearances through Top Secret. I can assure the reader that had I, or any of my cubicle-occupying white collar workers, committed a fraction of the the egregious abuses in control of classified material attributed to Clinton, we would have lost our jobs and been prosecuted. I was investigated by the FBI when there was no evidence whatsoever of compromise of classified material, in contrast with the plethora of evidence against the Hildebeest.

Being single, I had traveled to the then Czechoslovakia (now Czech and Slovak Republics)to meet a female pen pal, having duly reported my travel to our Security department as required. My desk had been rifled (some personal collectors’ items were stolen) and letters to my pen pal confiscated and turned in to the Security department who contacted the FBI. As a result, an FBI investigation was initiated. I had to hand-write a 20-page deposition explaining all I did (or rather didn’t do) for submittal to the FBI. A few weeks later I was interviewed, under oath (not required of Hillary), by a female agent for about two hours. I was asked whether I would submit to a polygraph test. I then thought it pertinent to ask whether I was being charged with a crime. When the agent ignored my question, I took that as a no answer and therefore declined the test.

I understand “the beest” was accompanied by lawyers for her “grilling.” I, of course, had none, and needed none, because i had not violated any procedure, regulation, or law. Unlike Hillary, I was more annoyed than worried about the investigation because I was totally innocent of any offense. End of story: I retained my security clearance, a requisite to the position I held, and stayed on the job until I was laid off during the wave of defense industry layoffs caused by the end of the cold war and the dissolution of the Soviet Union.

I think this story was planted by the Clintons as a way to contain the news cycle over the next week or two. Otherwise, in the wake of the FBI interview, and absent any other developments, the speculation would have been rampant

There is so much contradictory evidence about what is going to happen ... I think no one knows for sure. My estimate of odds is 60% no indictment, 40% some indictment.

The case for indictment:
There is so much evidence of felonious activity, it seems to be an open and shut case.
We are told Comey is a straight shooter (?)
Her people took the fifth for much of their testimony.
The Clinton/Lynch meeting looks like desperation by Billy Bob.
Her meeting with the FBI on Sat. Why have it if everything is innocent?

The case against indictment:
Clintons have power and FBI files on all those who matter.
Obama and Biden are talking about campaigning for her. Why do that if they know she is on the outs. (and they know)
The talk about Comey reminds me of John Roberts. He’ll do the right thing! Yeah, right.

Therefore low, but not impossible odds of indictment.

If the Defense Department materials were sent to her server, were they sent to her server by her? That theory would seem to be that someone else sent them to her.

I know none of these facts, but I am sure that the FBI does by now. So, we'll just have to wait and see what they have found. The act of removing materials from their proper place almost sounds like the description of a process that involves physical documents. Here we are dealing with electronic transmissions. Maybe the statutes need to be updated and maybe they should encompass the act of receiving electronic transmissions rather than just sending them.

We'll know more soon. I'm sure that the FBI has figured out what happened.

I didn’t think it was technically possible for SAP/top secret documents to be sent from a classified government network to a nonsecure system. But the Federal Records Act concerning electronic communications was updated in 2009 and thus in effect during her tenure.

The U.S. Code of federal regulations on handling electronic records is updated “Agencies that allow employees to send and receive official electronic mail messages using a system not operated by the agency must ensure that Federal records sent or received on such systems are preserved in the appropriate agency recordkeeping system.”

Wow. I wonder why they have to be permitted to use systems not operated by the government at all (even if all of the communications are preserved). I guess that they have their reasons for allowing it. This is why all this is so complicated for someone like me who doesn't work for the government. As for the Code of Federal Regulations, I don't know, but I would guess that there can be many failures to follow the code that don't amount to a crime. But, again, I just don't know.

I don't trust a lot of Federal agencies, but I do still trust the FBI. I have always been impressed by the FBI agents that I have known. I think that they will tell us the truth about what happened and whether or not it was a crime.
