Again, its not fair use for a professional PAC to use a copyrighted picture. So yes to avoid violating the law a professional has to follow the law on it.
Even if it was in the public as long as its copyrighted its illegal for a professional to use for anything other then what the law considers fair use and this application in no way met that threshold.
