I don’t know for certain. My understanding is they take whatever criminality found to the Attorney General’s office and the AG decides what charges to bring. Rumor is that if the AG fails to act some of the FBI persons would go public at that point. (likely destroying their FBI careers). Who knows...

it was probably proper for FBI not to comment earlier, as there are many people investigated who did NOTHING wrong and it would have been awful to smear someone innocent

by this late date, however, it is clear that there’s tons of evidence that Hillary’s not innocent
