Bad shoot. Trying to call it an accidental (negligent) discharge? Police should be better at handling a firearm than that.

With all the stuff in entertainment media, the guy may have been trying to escape the (fictionally inevitable) explosion and fire as seen on teevee and in the movies (but which isn't very common in real life.)

Only if you are a cop. "Use of deadly force" law operates differently for cops. Cops are authorized to initiate the use of force of violence in situations that are off limits to others.

at the time of the incident, the cop did not know that the driver was drunk, just that he was resisting arrest.
