That's not true. There is a cause of action for appropriation of likeness and/or name, completely divorced from trademark law. I just don't think the elements of that cause of action are met in this case.

I honestly never heard of this woman before, and I think I take your point about misappropriation of identity, but still I hope they are forced to give her some money.
If for no other reason than her parents have forced her to live her life as a gal named Harris.
I've heard many radio and TV persons chose names different than birth name to protect families...
just wondering???
