My beef with that question is the planted axiom within it. Namely, that it matters more whether the AP gets subpoenaed than it does if, say, Karl Rove gets subpoenaed. Or you. Or I.

What, are the AP and Fox holders of titles of nobility? Are they members of an established religion’s priestly class?

That was the Judge being subtly ironical in his opening - before concluding at the end that this was after all zero’s pick and that any possibility the nominee would pass through these questions by affirming Constitutional principles was ahem remote.
