Roberts had to claim that the penalties for not having Obamacare are taxes. The law itself says they are penalties, not taxes. IOW, Roberts had to unilaterally change their wording of the law to decide what he decided.
Also, there is at least one lawsuit working its way through the pipeline that challenges the way in which Reid took an unrelated bill that the House had sent to the Senate, deleted everything in that bill and substituted all of the Obamacare text in its place.
The interview is worth listening all the way through.
That would cover the military and agencies such as EPA, FDA, USDA, and CDC that work to ensure security and safe food and water. It is hard to argue that the government taking over an entire business sector falls into the category of "general welfare."
Far too often, people misinterpret the general welfare clause as meaning that the government should provide permanent dole, or that the government should be everyone's sugar daddy.

Great idea re CR. The first thing out of Boehner’s mouth should BE a) to remind everyone of the employer mandate waiver by fiat b) that the implementation of ACA has been incompetent c)that it will cost more and you will get less.
Boehner may be a good behind-the-scenes guy, but I wish he would delegate the media coverage to a more dynamic House member.

Regardless, one clause (general welfare) would NOT (can not) supersede the whole of the Constitution as laid out.

If this stand off is betrayed by the pubs, I will sending my money to the Tea Party organization (even though they don’t take on social issues which I think are important) and put the Gadsen flag sticker on my car proudly. Already we send no money to the RNC, only specific campaigns...

Ted Cruz isn't going to broadcast this, but I will: there is a strategy designed specifically for the 24/7 news cycle, i.e. the MSM cannot stick with a storyline for more than 3 days.
In short, the media mantra has been, the "Ted Cruz Government Shutdown." The sheer weight of the evidence is collapsing all around Obama and the Democrats: park closures, unwillingness to negotiate, etc.
While Cruz gets it, the GOPe doesn't...they're running around trashing Ted and the people that put them in the majority in the House...the Tea Party.
A few more days, and the narrative will change, so long as we keep the pressure on the GOPe to stand firm. The media is becoming exhausted in their attempt to prop up the Obama Administration. The Average American knows bull$hit when they see it, and they're seeing it 24/7.
The Average American doesn't care a whit about a "clean CR", particularly when the House sends to the Senate bills to fund the VA and keep the parks open.

Please note: I am not for Obamacare, but it was passed by Congress and signed into law by Obama. So we are - temporarlly - stuck with a lousy law.

Since I only give money to Tea Party candidates now my only caveat will be that they run independently. No more Pub party. Why have a Pub party if they do whatever the Rats tell them.
To avoid a split vote that favors the demonrats, I keep my Party affiliation in my state to vote in the primaries...

Yes but, the branches were given a set of unique powers. The senate has control of treaty and appointments. The house controls the purse strings. Revenue. Taxing authority.
If Øbamacare is a tax, then the house controls it. Or should at least in theory. These days the Constitution doesn’t seem to mean much to some people. Ahem! Obama!
Now he can call the agency specific CRs bipartisan. They need to hold out until at least Monday/Tuesday. Money is tight in the Democrat community.
