Dear any congressman:

Write legislation stripping the IRS of any power to freeze assets, seize assets and demand information not on a preexisting tax form. Take away their power of intimidation and give tax payers the same legal safeguards that a criminal court does including a jury of peers, reasonable doubt and innocence until proven guilty beyond a reasonable doubt. Also include criminal penalties for any agency of the government to use their office to bully constituents, influence elections or harassment. They of course are granted right to a fair trial but not a right to keep their job, make every federal position a right to work position. Call it the citizen protection and liberty act. Stop trying to score political points and legislate and the votes will follow the leader.

The IRS LOVES being considered brutal and uncaring. They're so undermanned for what they're actually supposed to do, that they have to intimidate taxpayers into "voluntary taxation". The fact that B. Hussein Obama (mmm mmm mmm) is using them as his own personal "Death's Head Execution Squad" is just a bonus.

Until I see actual IRS agents NAMED, ARRESTED, PERP-WALKED, and backround booing and hissing from the crowd like we heard from Timothy McVeigh or Ariel Castro, nothing's gonna change.

If that is true, he shows great promise. He also asked 2-3 relevant questions I thought were inciteful.

Agree with you, this is a start and lets hope it doesn't stop here...Any one that has been around for 4-5 decades is not surprised, the only surprise is it is being televised. And I don't think its going away...Democrats holding the house for 40 years and the senate also part of that time is the reason the IRS was given these powers...Can we say Domestic Terrorist..

Instead of ranting as the GOPe has done for days, they should be writing articles of Impeachment and getting a trial underway. Obama is clearly implicit in this. Also, all the IRS people responsible for this outrage should also be on trial and sent to Leavenworth. This is the only way we will keep it from happening again, otherwise where is the strength behind the constitution and separation of powers.

While we are at it, let's repeal the 16th and institute a Fed sales tax and tariffs and greatly reduce the size of the IRS and take away their powers to screw over citizens at will.

Thanks for printing out the rant thouworm.. I can see why everyone was applauding. Americans are sick of smug liberal elite assholes - must have stunned the smug wimp to know how much contempt the American people have for him and his bullies.

It is interesting to see Dem strategy blow up. The scandals feed on one another, and reinforce the perception of a pattern of deceit. The original plan was probably to ping-pong them until they both became “old”.

I will say thay low-information voters won’t have a prayer of keeping track of any of them, because it’s overwhelming. I do recall that during Watergate, the very helpful newspapers would almost daily print a “Q+A” and explain what was going on in very simple terms. I wonder if they will do that now, as though low-information voters would or could actually read.

Drudge has an interesting tidbit concerning Weiner’s wife, which probably would be worthy of examination if there wasn’t better and more interesting stuff to read. An individual Democrat cheating the system for themselves is hardly even newsworthy these days.

I think we all are having confirmed what we all , that the Democrats have NOT stayed in power for 40 years because the majority of the people agree with them. They’ve been using the IRS, unions, foreign money, people like George Soros, to fund and pay for the illegal election rigging.

People need to be arrested, tried and put in prison for this. Until that happens (and some plea bargains for the lower level people in return for ratting out their superiors) this tyranny will continue.

The RICO Act focuses specifically on racketeering, and it allows the leaders of a syndicate to be tried for the crimes which they ordered others to do or assisted them, closing a perceived loophole that allowed someone who told a man to, for example, murder, to be exempt from the trial because he did not actually do it.

RICO was enacted by section 901(a) of the Organized Crime Control Act of 1970 (Pub.L. 91–452, 84 Stat. 922, enacted October 15, 1970). RICO is codified as Chapter 96 of Title 18 of the United States Code, 18 U.S.C. § 1961–1968. While its original use in the 1970s was to prosecute the Mafia as well as others who were actively engaged in organized crime, its later application has been more widespread.

Summary [edit]Under RICO, a person who is a member of an enterprise that has committed any two of 35 crimes—27 federal crimes and 8 state crimes—within a 10-year period can be charged with racketeering. Those found guilty of racketeering can be fined up to $25,000 and sentenced to 20 years in prison per racketeering count. In addition, the racketeer must forfeit all ill-gotten gains and interest in any business gained through a pattern of “racketeering activity.” RICO also permits a private individual harmed by the actions of such an enterprise to file a civil suit; if successful, the individual can collect treble damages (damages in triple the amount of actual/compensatory damages).

When the U.S. Attorney decides to indict someone under RICO, he or she has the option of seeking a pre-trial restraining order or injunction to temporarily seize a defendant’s assets and prevent the transfer of potentially forfeitable property, as well as require the defendant to put up a performance bond. This provision was placed in the law because the owners of Mafia-related shell corporations often absconded with the assets. An injunction and/or performance bond ensures that there is something to seize in the event of a guilty verdict.

In many cases, the threat of a RICO indictment can force defendants to plead guilty to lesser charges, in part because the seizure of assets would make it difficult to pay a defense attorney. Despite its harsh provisions, a RICO-related charge is considered easy to prove in court, as it focuses on patterns of behavior as opposed to criminal acts.[4]

There is also a provision for private parties to sue. A “person damaged in his business or property” can sue one or more “racketeers”. The plaintiff must prove the existence of an “enterprise”. The defendant(s) are not the enterprise; in other words, the defendant(s) and the enterprise are not one and the same. There must be one of four specified relationships between the defendant(s) and the enterprise: either the defendant(s) invested the proceeds of the pattern of racketeering activity into the enterprise; or the defendant(s) acquired or maintained an interest in, or control over, the enterprise through the pattern of racketeering activity; or the defendant(s) conducted or participated in the affairs of the enterprise “through” the pattern of racketeering activity; or the defendant(s) conspired to do one of the above. In essence, the enterprise is the illegal device of the racketeers. A civil RICO action, like many lawsuits based on federal law, can be filed in state or federal court.[5]

Both the federal and civil components allow the recovery of treble damages.

Although its primary intent was to deal with organized crime, Blakey said that Congress never intended it to merely apply to the Mob. He once told Time, “We don’t want one set of rules for people whose collars are blue or whose names end in vowels, and another set for those whose collars are white and have Ivy League diplomas.”[4]
