Well your argument appears to be pragmatic, that "mad dog bombers" or whatever trump the fourth. Wrong again, nothing trumps the 4th, well may martial law does, I have not read up on that.

Are you telling me Paul Revere didn't participate in the American Revolution?

Do you know what people do in warfare?

Revere himself is quoted as having said ~ regarding his own intelligence operations "in the Fall of 1774 and winter of 1775, I was one of upwards of thirty, chiefly mechanics, who formed ourselves into a Committee for the purpose of watching British soldiers and gaining every intelligence on the movements of the Tories." According to Revere, "We frequently took turns, two and two, to watch the (British) soldiers by patrolling the streets all night.",

Guarantee he didn't get warrants!

Hardly. But some of you want to turn this guy loose because you think someone else's 4th amendment rights might have been violated in the course of capturing him.

They became cops for the opportunity to smack perps upside the head and shoot people ~ of course ~ everybody knows that. I trust them much more than you when it comes to finding some perp to smack upside the head.

That appears to be a situation where ‘they’ were not the owner. Always a problem when the owner invites the cops in to search the place.

Unfortunately you are the one who wants to turn him loose. Case law is well established and illegal searches have overturned convictions. Thankfully there was no evidence against this guy gathered during any illegal searches (that I am aware of). Furthermore I read the indictment and there is a boatload of legally gathered evidence. So his conviction is safe.

You are correct! The owner of a property trumps the rights of the tenants. If he says search, then the cops can search.

You are the one who thinks it's a stupid remark yet Paul Revere himself spoke of patrolling the streets watching British soldiers and TORIES!

So, where were those Tories? in their homes ~ maybe in their businesses ~ and where was Paul Revere's warrant?

You are the one who raised the question of Revere, but he was in a war, and hey, I think we are still in a war.

I don't want to turn this guy loose at all ~ but no matter how someone else's 4th amendment rights might seem to have been violated, that has no bearing whatsoever on HIS 4th amendment rights ~ plus they already had warrants to search his and his brother's places of residence, their cars, etc. That'd been done.

The Middle East is where you need to go to find societies that EXTEND a householder's rights under the law to his guests ~ and if you have sufficient rank the magistrates cannot come in, and the criminals there are safe.

The 4th amendment does not extend the middle eastern rights of hospitality to mad dog bombers hiding in your boat! Besides, nobody tried to hide him.
