Based on a quick Internet review, it appears that the victim’s past history can be used in a murder trial if the prosecution opens the door by trying to show the victim was a saint who would never have started a fight.
Lawyers are welcome to jump on me and show me what that quick Internet review is wrong. My guess is Zimmerman’s lawyer is doing this to preempt an attempt by the prosecution to claim sainthood for Martin.
In cases of rape, the victim is almost always shielded. I think that is wrong, but the law doesn’t care what I think.
That’s why the defense wants Trayvon’s school records as well.
There’s no “open wound,” they’re trying to profit from their son’s death in any way they can.
Hey Palpatoon, Zimmerman is the only victim, Martin was the neutralized perp.
this case was supposed to be to show evil gun carrying nazi republicans with german names were killing young black boys so that inner city minoirities had better vote for the President.
Instead, the shooter turned out to be a metziso (which is the correct term for white/Indigenous Hispanic) and a Democrat...
On the other hand, the silence of the media suggests that Zimmerman’s lawyers might indeed find something interesting in the discovery phase of the trial...
I think Martin’s online posts, coupled with his school discipline record, is instructive in painting a portrait of Martin’s character.
And remember - comments on this board are anonymous; and, people may be a little more superlative than they would be in real life. Martin’s Facebook posts (and photographs) were not anonymous.
Nor was there the ‘safety’ of distance. Presumably many of his Facebook friends were people who lived close by, and at least one I remember was a close relative.
I do not think his Facebook posts reflect an alterego at all...most likely a very accurate portrayal of his character.
This case was initially tried in the media - we were treated to photos of an almost prepubescent boy, and told he was hunted down by a racist whose only concern was his race (thank you NBC) and gunned down. You might remember that many people were quite confident he had been shot in the back. Almost any potential juror, who hasn’t been living under a rock, has been tainted by this. I do not blame the defense one bit for trying to correct that narrative, even if it means ‘trying the victim’.
