Actually, you can!
If you are subject to this tax (or penalty or fine ...)...
1) The IRS cannot impose criminal penalties for nonpayment
2) The IRS cannot impose penalties or interest, cannot seize money or property to satisfy it.
So ... you can refuse to pay it with absolutely no consequences.
