A person can be brought in for questioning without being arrested, right?
It depends. If a person is forcibly restrained, they are under arrest. There is a sort of halfway situation that is known as "being detained". The courts have ruled that police can "detain" a person for a few minutes while they ask them questions. More that about 15 to 20 minutes is considered an arrest.
It does not really matter what the police call it. If a person is forcibly restrained for more than a few minutes, they are under arrest.
If they know they can leave, but voluntarily remain with the police while they are questioned, that is not an arrest.
An arrest requires that a person be read their rights - does that happen if they’re just being detained? Do you know if Zimmerman was read his Miranda rights? By the way Mark - it’s always nice when you take the time to explain things - it’s appreciated.
That is not quite true. If they are arrested, and questioned, and not read their rights, then the evidence gained may be thrown out of court. They would still have been under arrest.
I do not know when or if George Zimmerman was read his Miranda rights. It appears that he fully cooperated with police. If he volunteered the information about the attack and his self defense claims, then Miranda warnings would not apply.
The 'photographer' was a guy with a cell phone camera who lived right there. He heard the fight and came out to see what was going on.
When I first came across this story, and posted it on freerepublic, the story had a photograph with it. I did not post the photograph, but as the story was about a black teenager being shot, I made the assumption that the photograph was that of the black teenager.
I quickly discovered that the photo was that of George Zimmerman. I have know black people who are of lighter complexion than George Zimmerman.
