They raided this home on the results of a home burglary? And dropped the charges on the buglers.
How do they know that the files collected came from the defendant? They could have been part of the burgers home stash, etc, etc.
The cops can “know” by fingerprints on the discs, or more likely by other porn in the house after they get a search warrant.
They could have saved themselves by staying quiet.
“We’re burglars, and thought you should know that the guy on 123 Elm street is a kiddie porn fiend. We found these on his desk in the back room, next to the big potted plant. We didn’t swipe his crappy computer because it was old and heavy. You’ll probably find the pervs fingerprints on these, and more porn on his computer and other discs we didn’t steal. Hope this helps. We may be bad but we ain’t evil.”
Or, they could have hired a lawyer to offer the evidence in exchange for immunity.

If he'd left his stack of old 1.44mb 3.5" floppy discs laying around, those burglars would have cleared him out of those too! They're rarer than hen's teeth now!
Right: They didn't go looking for guns and jewelry in all the likely places, instead they took the clumsy to conceal stack of CD-ROMs and left the electronics behind.
This story stinks. Oh well, the ends justify the means, I guess.

I expect porn guy will be charged for whatever is recovered as a result of the warranted search. Burglar guys will probably get some lesser charge, like criminal tresspass or somesuch. The American ‘criminal justice’ racket is a circus. Tom Wolfe’s ‘Bonfire of the Vanities’ was a fair representation of its workings.
It's not his stuff the kids broke in and put it there.
Unless his fingerprints are on the stuff.
