The Senate also voted for a "call of the house," which is the mechanism used to compel senators to return to the chamber.

If the compelled senators fail to appear, then does that give the state any rights to consider the positions as vacated and thereby redefining the quorum to be based on the number of senators that did appear? Just wondering.

Article IV, §15
Exemption from arrest and civil process. Section 15. Members of the legislature shall in all cases, except treason, felony and breach of the peace, be privileged from arrest; nor shall they be subject to any civil process, during the session of the legislature, nor for fifteen days next before the commencement and after the termination of each session.

They are going easy on them. There is a law in the books indicating it is a FELONY for a public servant to skip out on their duties.

Wisconsin statutes:
946.12
946.12 Misconduct in public office. Any public officer or public employee who does any of the following is guilty of a Class I felony:

946.12(1)
(1) Intentionally fails or refuses to perform a known mandatory, nondiscretionary, ministerial duty of the officer’s or employee’s office or employment within the time or in the manner required by law; or

946.12(3)
(3) Whether by act of commission or omission, in the officer’s or employee’s capacity as such officer or employee exercises a discretionary power in a manner inconsistent with the duties of the officer’s or employee’s office or employment or the rights of others and with intent to obtain a dishonest advantage for the officer or employee or another; or

I am thinking they will let themselves be arrested. They become martyrs for the cause then. The left loves to do that.

No joke. I understand crossing the state lines is not going to happen, but some interprising citizens might bag some of these birds (maybe beat them accidently) and then deposit them on the steps of the capitol.

Would be interesting to see if they get one of the dems and then have him/her detained in the locked/guarded chamber so that a vote could be taken... he/she no doubt would be running around the chamber looking for an open door (like a rat searching for a lump of cheese at the end of a maze).

I’ve heard all week about deadlines, final chance...on and on.

So far...NOTHING has happened.


Here's one. The Repub's are sticking with not allowing the dem's direct deposit of their pay. They are not getting paid unless they show up. One Dem tried something cute, but was rebuffed. From JSonline, Senate Republicans threaten missing Democrats with contempt

......."Republicans have also decided absent Democrats can no longer have their paychecks directly deposited into their bank accounts and will have to pick them up from Fitzgerald on the floor of the Senate.

Erpenbach gave power of attorney to his chief of staff, Trig Knutson, so Knutson could pick up his check. Knutson attempted that Thursday but was rebuffed.".............

They should also be required to pay damages to the State for their illegal walkout. The Union should also be fined for damages to the Capitol Buildings and staging an unauthorized strike which interfered with State Business.

My guess is that this is a deal worked out by the REp. Senator leader (Fitgerald?). This way the dems can save face as they are brought in under protest. The dems need cover.
