Actually, provided the release is carried out using the same protocols the Russians use with Somali pirates—rubber dinghy, about 2000 km out in the Indian Ocean—catch and release seems to work fairly well.

This is not exactly true. Witnesses were not called, and the defense case was not put on at that time because the evaluation into PFC Lawrence’s mental status had not been returned. The defense asked TWICE for the Article 32 to be delayed until the report came back, and were TWICE denied, so the hearing went forward anyway. The statement in the news was, until they know whether or not PFC Lawrence is mentally competent to stand trial, they cannot build their case. Once the results come back, then the defense will ask to reopen the hearing to present their side.
The defense was able to question all the prosecution’s witnesses, however. The government put all their cards on the table at the hearing. It seems a lot of statements came out over the two days that can benefit the defense once it is ready to put on it’s case. PFC Lawrence was moved to a psych facility a week ago, and from his support page on facebook yesterday, there’s no new news as of yet.
