I don't know what type of holster it was, but A) someone trying to commit 'suicide by cop' would have pulled the gun, not the gun in its holster, and B) I'm concerned that the inquiry seems to be focused on suicide by cop rather than focusing on what happened. It is still ongoing, but so far the testimony has come from Costco employees and the closest cop.

It may be the drugs Scott was using clouded his judgment in how to respond, but I don't see any indication that he was trying to force the police to shoot him. Not if he pulled a holstered gun.

While the victim's use of painkillers doesn't provide any excuse for the men who killed him, it would explain why he was considered to have been behaving strangely.

It's possible - and this is pure speculation - that he, like many normal Americans, developed a dependency on drugs that were prescribed following a medical situation (like surgery, physical rehab, etc.)

That's much more plausible to me than the claim that he was "suicidal."

I’m not buying any of this. Too many eyewitness accounts within feet of Scott tell a different story. And Las Vegas has a record of lying/covering up.

The murdered man is reported to be a West Point graduate and veteran with university degree(s) and a successful representative for a company that sells medical devices. This is mentioned in virtually every report I have seen until this inquest when suddenly he is a drug-addled, beligerent gun nut and very possibly suicidal to boot. It has been months since the shooting and none of this was reported until this inquest.

Technical malfunctions certainly occur. Amazing how this one just happens to coincide with this murder. This stinks to high heaven.

Doesn’t LAPD have any standards covering minimal physical requirements for its officers? I guess not based on the picture of the one who led the firing squad.

The officer who shot from the front needs to up his caliber to soemthing starting with a “4”, as in .45. Two shots center mass and the perp backed up and turned around before falling forward after taking five more rounds to the back. ‘9mm will not save you, friends, unless you can make head shots, consistently.’

Uhm, officer Mosher, you also told him to "DROP IT!"

One of the pics on this link http://www.lasvegassun.com/news/2010/sep/23/erik-scott-day2/ show a graph with Scott’s morphine level at 1800ng/ml and the lethal level show at 70-350 ng/ml.

WTF? He had 5-25 times the lethal amount?

The jury MUST assume that the video would be STRONGLY in favor of the victim. In any case where the accused are a) cops, and b) the party in control of the video equipment that allegedly 'malfunctioned' (Costco), THAT'S THE ONLY ASSUMPTION that promotes liberty and opposes tyranny.

Cops and other responsible parties (video camera operators) should ALWAYS ASSUME THAT THAT WILL BE THE WORKING ASSUMPTION of a jury when evidence under their control goes missing. They should guard such evidence as though their life depended on it—because it SHOULD!

Las Vegas Metro is utterly corrupt, where else does a police officer of the law have a stripper as wife and have it seen as “normal” behavior.

They have open jails with no cells. How would you like to be a guard in that jail??

How is it the Dallas Police were able to arrest this leftard wacko inside a movie theater with only minor damage (he did resist arrest), knowing he was armed, dangerous, and, at the very least, a cop killer?

Yet, in far less difficult circumstances, these Las Vegas pigs killed a West Point grad who was none of the above.

It may be the drugs the police officers were using clouded their judgment in how to respond, but ... they murdered him anyway, according to several of eye witnesses.
