The 14th amendment as interpreted by the courts disagrees. The amendment itself says, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside..."

Someone here illegally or as a tourist is NOT subject to draft laws, tax laws, etc. Therefor, they do not fall under the 14th IMHO.

Unfortunately, My Humble Opinion doesn't decide court cases, and I'm certain it would require a constitutional amendment to change how the courts look at it.
