the Judge's prior rulings in abortion protest litigation, her husband's outspoken criticism of Catholic pro-life teachings while serving as a tenured philosophy professor at Notre Dame Whaaaaat? Judge Jenny's husband is an emeritus prof for one of the litigants in the case before her and she tried not to recuse herself? Isn't that grounds for an ethics complaint all by itself?

Under the argument being made by the ND88, a private Catholic university would be unable to stop homosexualists from holding a “gay pride” demonstration on campus.
The University of Notre Dame made a dumb decision to invite 0Bama and to treat prayerful protesters as trespassers.
But the campus is private property, and private property owners should have a right to keep whomever they wish off of their property for whatever reason.
The argument being made is actually harmful to Catholic institutions because a ruling in favor of the ND88 on the grounds mentioned in this article would end up making it illegal for a Catholic university to keep unwanted activities off of their campus.

EV, you are missing the point: A private property owner gets to decide who is trespassing and who is not.
Under the logic you are using,
a pro-life private property owner
can’t keep
pro-abortion demonstrators
off of his private property
during
a pro-life demonstration.
The cure you suggest is far worse than the disease.

The campus is open twenty four hours a day. If you went to South Bend right now you could walk anywhere you wanted on the grounds, unimpeded.
At the time in question, supporters of Obama were allowed to continue to do so, with signs or whatever.
Anti-Obama protesters were treated differently, based on nothing more than the content of their speech.
