It’s imperative that the Dems freeze out the Republicans and do this all themselves. It is then imperative that the incompetent pubes get on message and campaign with this news to prove to the voters just how out of control the Dems are.

Your statement presumes that the Republicans actually have some say in the matter. They don't. That's what happens when the opposition has sizable majorities in the House and Senate. There really isn't anything the GOP can do until the 2010 elections.

No, they needed 41 votes. The GOP caucus has only 40 votes - one short of effecting a successful filibuster. They couldn't filibuster because they simply didn't have the requisite number of GOP Senators.
