If this was actually delivered and is being investigated, would it provide a possible explanation for why there has been no decision by Judge Carter?

Probably not. Smith's alleged allegations (see what I did there?), don't have any relevance to the merits, or lack thereof, of this case.

This MTD will be decided on long-standing and well-tested principles of American jurisprudence. Alleged subornation of perjury won't sway the judge, one way or the other, IMHO.

Lastly, I'm not at all surprised by the "delay". That's just the pace of events in Federal Court. We've been spoiled in a few other cases with much quicker decisions, but those all involved the exigency of a TRO. This case doesn't.

We would agree, but time is running and if it was actually filed with the court we would expect at some point soon there would have to be something in the actual record about it. While it is common for there to be a delay beetween filing and docketing, the docketing is generally a clerical decision and it should not take as long as this for it to appear there.


Orly’s response to a supposed affidavit by Larry Sinclair and it’s Pacer status. Take it for what it’s worth as I have no idea if it’s the truth or just Orly’s ramblings..

First, there was a rumor that there is a a declaration by Larry Sinclair filed with court. Please, go on Pacer, it is a public record. There is nothing there, no such declaration. People need to understand that a person cannot just come from the street and file a declaration or an affidavit. It has to be filed by a party to the action. Either I, as an attorney for the plaintiffs or attorney for the defendants, assistant US attorney would file something. Neither I nor US attorney filed any such affidavit or declaration.

We don’t know if the document is real or if Smith’s web site was compromised as a fraud. It is difficult to see how someone who has filed a statement under the statutory penalty of perjury would compose such a document and think that he would do anything other than get himself in hot water. If it were real one would think that the DOJ would seek to take advantage of it. If it has actually been submitted to the court the judge would have, before it was received, been looking into the document that was filed which the letter calls into question and would already have made some sort of determination as to whether it was sufficient to be allowed to be investigated further and, yes, such a letter, might affect that deliberatrion but it is not clear just how. The most likely thing would be that it would be put in the record as part of the proceedings to get to the bottom of what would be a very puzzling situation.

Orly is nuts so I wouldn't rule any of this out.

This same lady was donating money to Hussein via the Democratic Senatorial Campaign Committee as recently as 2006. Now she's the self-appointed leader of the movement to oust him? Strange.

NS has been trying for four years to bash us ‘birthers’ and it hasn’t worked yet. I remember him/her with the “let’s beat Obama in the ELECTION!!!” crap. How’s that working out NS?
